Terms and Conditions

These "Terms and Conditions" represent the contractual relationship between you and "Roger Gracie Amsterdam".

Roger Gracie Amsterdam operates from Revaleiland 121, 1014 ZG, Amsterdam, The Netherlands, and Johan Huizingalaan 91, 1065 HW, Amsterdam, The Netherlands.

In order to be able to use our services, these Terms and Conditions need to be accepted by you (if adult), or your parent or legal guardian if you are underage or legally unable to sign.

1. Membership, fees and payment

1.1 Your membership will begin straight after you complete the online sign up.
1.2 Payments of the monthly fee are collected via direct debit on a monthly basis, at the beginning of each month. Days can vary due to weekends and holidays.
1.3 The monthly fee is determined by the initial membership type chosen (1 year, 6 months, or 1 month) and is debited even if you chose not to use the academy.
1.4 Your membership is personal and may not be used by another person or transferred over.
1.5 Roger Gracie Amsterdam may change the amount of your monthly fee, before any changes are made Roger Gracie Amsterdam will notify you via email at least 30 days before the changes take place.
1.6 Additional Fees are taken with your first payment for the starting package (official uniform, official rashguard, and official belt).
1.7 You agree to the automatic payment of the registration cost and the membership fees of Roger Gracie Amsterdam, as well as any additional purchase you make. Hereby you authorize Roger Gracie Amsterdam to automatically debit your account for the registration cost and the membership fees (every month), as well as any additional purchase you make.

2. Membership renewal, cancellation and suspension

2.1 After the full initial contract period specified by the membership package chosen (1 year, 6 months, or 1 month) is completed, the contract will automatically be renewed on a monthly basis for the same amount.
2.2 It is not possible to terminate the contract within the initial contract period.
2.3 After the full initial contract period has passed, the contract may be terminated with 14 days notice by writing to info@rgaamsterdam.com. A confirmation email will be sent back. Queries on canceled memberships can only be dealt with when a copy of this letter is provided.
2.4 It is possible to suspend a contract within the first full period in case of:
Pregnancy - for up to 12 months.
Injury - the duration of the suspension depends on the medical advice and written proof needs to be provided.

3. Temporary passes

3.1 If you purchase a temporary pass, its validity starts right after the purchase is completed and you are allowed to use the services provided by Roger Gracie Amsterdam until it expires. The duration of the pass is specified in the pass itself and is visible in the webshop.
3.2 The payment is collected via the webshop or mobile app and cannot be refunded.
3.3. The pass is personal and may not be used by another person or transferred over.
3.4. The person that uses a pass adheres to the Academy rules/etiquette (Dojo etiquette, Code of Ethics, Guidance for Parents) that can be found at the mat area and at the end of this document.
3.5. Roger Gracie Amsterdam is entitled to refuse to provide a service to the person that purchased a pass in case of any breach of contract or lack of observance of the Academy rules/etiquette (Dojo etiquette, Code of ethics, Guidance for parents).

4. Academy Rules

4.1 Roger Gracie Amsterdam policy requires all students to train only with the official Roger Gracie Uniform.
4.2 You adhere to the Academy rules/etiquette (Dojo etiquette, Code of ethics, Guidance for parents) which forms part of this agreement. They can be found at the mat area and at the end of this document.
4.3 The Academy rules/etiquette may be changed at any time. Roger Gracie Amsterdam will notify any changes to you.
4.4 Roger Gracie Amsterdam is entitled to terminate your contract with immediate effect and without prior notice for any breach of contract or lack of observance of the Academy rules/etiquette (Dojo etiquette and Code of Ethics)
Roger Gracie Amsterdam reserves the right to update, change or replace any part of the rules, guidelines, policies and schedule by informing the students about the updates. The continued attendance following the updates of any changes constitutes acceptance of those changes.

5. Changing the Agreement

5.1 Roger Gracie Amsterdam may change this agreement at any time. 30 days notice will be given if any changes are made and sent to you via email.

6. The Academy

6.1 You are entitled to participate in the classes provided by Roger Gracie Amsterdam designed for your experience level.
6.2 Roger Gracie Amsterdam can refuse your access to the Academy if considers your health may be adversely affected by participating in the classes, or if considers that your health may adversely affect other students.
6.3 The Academy may close or the opening times may change during public holiday periods. Facilities may also close and training sessions may be canceled for occasional special events and seminars. Notice of these events will be emailed to you in advance notifying you of any changes. No refunds will be available for these periods.
6.4 Roger Gracie Amsterdam may change the opening times or withdraw any of the facilities at any time if needs them for events, tournaments, exhibitions or other special activities.
6.5 Roger Gracie Amsterdam may need to close the Academy or change the opening times for repair/refurbishment or improving customer service. Classes may also have to be canceled due to unforeseen instructor unavailability. In the above circumstances, Roger Gracie Amsterdam will use its best endeavors to give as much notice as is reasonably practicable by emailing you or displaying at the Academy.
6.6 Roger Gracie Amsterdam management team reserves the right to change the class schedule.

7. Photo/Video Consent

7.1 You give Roger Gracie Academy permission to take photographs and or video of yourself (or your child). You grant Roger Gracie Academy full right to use the images resulting from the photo\video filming, and any reproduction or adaptation of the images for promotional, publicity, fundraising or educational purposes. This might include (but is not limited to), the right to use them in their printed and online publicity, social media, press releases and any commercial applications.

8. Junior Members and Children.

8.1 A parent or guardian must sign this agreement on behalf of children and junior members (under 18 years of age). By signing this agreement the parent or guardian agrees to be responsible for the behavior and actions of the minor at all times and payments of all the costs on their behalf.
8.2 Students under 16 years of age must train with the junior and children teams. In special cases, and in agreement with the Management and the parents, a minor can join the adults team before turning 16. Students older than 16 years train with the adults team.
8.3 When you reach 18 your junior membership will end, you will become a full adult member.

9. Waiver & Release of Liability

9.1 You hereby acknowledge and understand that martial arts training is a physical activity and involves physical contact. Roger Gracie Amsterdam, SportmaniXL, and/or its staff and students are not to be held liable or responsible for any risks and/or injuries that may occur as a result of training or while watching or participating in activities at Roger Gracie Amsterdam for any reason whatsoever, including ordinary negligence on the part of the members of Roger Gracie Amsterdam instructor/coach, member, volunteer, or agent of Roger Gracie Amsterdam or any other participant, visitor, or person present at or participating in activities supported by Roger Gracie Amsterdam.
9.2 Roger Gracie Amsterdam, SportmaniXL, and/or its staff and students are not to be held liable or responsible for any loss of property occurred while watching or participating in activities at Roger Gracie Amsterdam for any reason whatsoever, including ordinary negligence on the part of the members of Roger Gracie Amsterdam instructor/coach, member, volunteer, or agent of Roger Gracie Amsterdam or any other participant, visitor, or person present at or participating in activities supported by Roger Gracie Amsterdam.
9.3 In consideration of your participation, you hereby release and covenant not to sue Roger Gracie Amsterdam instructor/coach, member, volunteer, or other staff for any or all present and future claims resulting from ordinary negligence on the part of the Roger Gracie Amsterdam or others listed for property damage, personal injury, or wrongful death, arising as a result of my engaging in or receiving instruction at Roger Gracie Amsterdam sponsored activities or any activities incidental thereto, wherever, whenever, or however the same may occur. You hereby voluntarily waive any and all claims resulting from ordinary negligence, both present and future, that may be made by you, your family, estate, heirs, or assigns.
9.4 Further, you are aware of the following risks, and numerous other inherent risks in observing or participating in martial arts and other activities sponsored by Roger Gracie Amsterdam. These risks include, but are not limited to death or serious injury resulting from: physical contact while observing or participating in activities supported by Roger Gracie Amsterdam; including, but not exclusive to collision (with other persons or objects), being struck on the body or head, being thrown or dropped, suffocation resulting from choking or strangulation, dropped equipment, dehydration, exertion, while participating in activities at Roger Gracie Amsterdam.
9.5 You are voluntarily participating in this activity with knowledge of the danger involved and hereby agree to accept all inherent risks of property and personal damage or death. By purchasing a membership, a temporary pass or participating in any training or activities organized or sponsored by Roger Gracie Amsterdam you are giving your consent.
9.6 You further agree to indemnify and hold harmless Roger Gracie Amsterdam and any other listed for any and all claims arising as a result of your engaging in or receiving instruction in activities sponsored by Roger Gracie Amsterdam, or any activities incidental thereto, wherever, whenever, or however the same may occur.
9.7 By accepting this document, you acknowledge that you have voluntarily chosen to participate in physical exercise. In accepting this document, you acknowledge being informed of the strenuous nature of the activity and the potential for unusual, but possible, physiological results including but not limited to abnormal blood pressure, fainting, heart attack or even death.
9.8 You also understand that you may stop any training session at any time. By accepting this document, you assume all risk for your health and well being and any resultant injury or mishap that may affect your well being or health in any way and hold harmless of any responsibility, the instructor, facility or persons involved with the program and testing procedures.

10. Privacy policy

This is the privacy statement of Roger Gracie Amsterdam (registered in the Trade Register of the Chamber of Commerce with number 78068010).

10.1 Why does Roger Gracie Amsterdam have a privacy statement?

If you have a Roger Gracie Amsterdam membership, visit its website or facilities, use its mobile app or are in contact with Roger Gracie Amsterdam via email, phone, its website or its social media, or face to face, Roger Gracie Amsterdam needs certain personal information from you and wants to be transparent about the processing of your personal data.

10.9 Does Roger Gracie Amsterdam provide information to third parties?

In principle, Roger Gracie Amsterdam does not provide or sell data to third parties. Roger Gracie Amsterdam may be required under the law or regulations to process your personal data and/or provide it to third parties. For example, if a competent authority such as the police requests this in the context of a criminal investigation.

10.10 What influence do you have over the processing of your personal data?

Everyone has the right to view, correct, or add to their personal details, to have them corrected or added to, to have them deleted, to request a restriction to process, to have them transferred, and to object to the processing of his or her personal data. You can request that your personal data be deleted and this request must be complied with in the following cases: because the data is no longer necessary for the purposes for which it was collected or processed, because you withdraw your consent because you have successfully objected to its processing, because the personal data have been processed unlawfully, or to comply with a legal obligation.

10.10.4 Restriction to processing
You have the right to request and be granted a restriction to processing in a number of specific cases: during the period of a dispute as to the correctness of personal data and the checking thereof, if the processing turned out to be unlawful but you do not want the data to be deleted, if Roger Gracie Amsterdam does not need the data anymore but you have need the data for a legal claim, and when you object to the processing and you are awaiting a reply to the objection.

You request that your personal data be blocked (temporarily locked) with the aim of restricting processing in the future.

10.10.5 Portability of data

You have the right to have your data transferred. This means you can request and receive a copy of your personal data that could then be used by another service provider, for example. ADDENDUM 1

Dojo etiquette

1 - Bow to the center of the mat when you enter and exit.
2 - Keep a respectful posture on the mat.
3 - Classes begin with students lining up in descending grade order.
4 - Classes end with a formal bow to the instructor, lining up in descending grade order.
5 - When the instructor is demonstrating the techniques, every student must pay attention.
6 - If you are late, sit by the side of the mat and wait for the Professor to invite you onto the mat.
7 - If you need to leave the class early you must ask the Professor for permission.
8 - Bow to your partner before and after practice.
9 - Talking should be kept to a minimum level and relate to the class.
10 - Absolutely no foul language inside the school.
11 - Keep finger and toe nails short for everyone's safety.
12 - Uniforms must always be clean.
13 - Shoes or flip flops must be worn at all times outside the mat.
14 - The kimono must be worn at all times.
15 - The belt represents your progress; keep it on.
16 - All metal objects, jewelry, piercings, necklaces or other such items must be removed.
17 - No shoes, food or drink on the mat.
18 - No mobile phones on the mat.

ADDENDUM 2

Students code of ethics

I hereby pledge to always do my utmost and nothing less, by following roger gracie academy code of ethics:
- I intend to develop myself in a positive manner and avoid anything that will reduce my mental growth and physical health.
- I intend to develop Self-discipline in order to bring out the best in others and myself.
- I intend to use what i learn in class constructively to help myself and and my training partners and never to be abusive or offensive.
- I will abide by and promote the guiding principles of maximum efficiency and mutual welfare inside the dojo and outside as well.
- I will always set a good example for lower belts and be aware that they will try to emulate senior practitioners.
- I will act wholeheartedly, without hesitation and show reverence toward the practice of jiu-jitsu by keeping my mind in it.
- I will seek to live by higher standards of conduct and understand that our code of ethics and conduct transcends the training room.
- I will spread the art of jiu-jitsu in a positive and respectful manner.
- I will behave honourably, never be impolite, try to live by the tenets that guide the art such as: courtesy, integrity, self-control, discipline and perserverance.

ADDENDUM 3

Guidance for parents

1- Please refrain from coaching your child from the side of the mat.
2 - Maintain positivity in respect to your child's progress, they will learn in time.
3 - Avoid focusing on winning and losing - a loss is an opportunity to learn.
4 - Allow time at home to practice tying the belt. This is an act of discipline.
5 - Please ensure that your child's gi has been washed before the class.
6 - Provide appropriate footwear to wear between the mat and changing rooms. Absolutely no shoes on the mat.
7 - Your child's finger and toe nails must be kept short.
8 - Children should not be running around before class.
9 - If your child has a cold or is unwell they should not attend. This prevents the spreading of illness.
10 - Please do not ask the instructors to grade your child. The instructors know when they are ready.
11 - No food or drink on the mat.
12 - Parents/guardians are not allowed on the mat.
13 - It is forbidden to take photos or videos of children on the mat or around the academy.
